Research findings from the Women and Children Research Network and the University of Toronto reveal that a staggering 95% of Afghan women avoid seeking justice for their cases due to profound distrust in the legal system. This study points to the complete removal of female judges, prosecutors, and defense attorneys as a factor leading to an unsafe judicial environment for women. Additionally, 65% of respondents reported having a wholly negative experience with legal proceedings.
In response to these troubling statistics, Richard Bennett, the UN Special Rapporteur, characterized the situation as critical and called for significant international pressure on Kabul. He emphasized that the exclusion of women from the judicial framework is not only a clear violation of human rights but also contributes to the legal isolation of women and an increase in hidden domestic violence in Afghanistan. The international community believes that without the reinstatement of fair trials and the presence of female experts, social justice in the country will be entirely paralyzed. For instance, the UN Human Rights Rapporteur is working to address alarming health rights violations for Afghan women, illustrating the broader issues affecting their well-being.
